The website www.spoticar.co.uk (“Website”) is owned and operated by Peugeot Motor Company Plc trading as SPOTiCAR (hereafter referred to as “SPOTiCAR”, “We”, “Our” or “Us”) and is hosted in Europe. We are a public limited company registered in England under company registration number 148545, the registered office address of which is: Pinley House, Sunbeam Way, Coventry, West Midlands, CV3 1ND. 

These are the terms and conditions on which SPOTiCAR introduce you to your selected retailer (“Retailer”) and Stellantis Financial Services UK Ltd for the purchase of your used vehicle (“Vehicle”) as selected by you via the Website. 

As a user of Our Website (“You” or “Your”), You acknowledge that such use is subject to Our terms and conditions set out below. Please read the terms and conditions set out here before using the Website.  By using this Website, You will be giving Your consent to abiding by these terms and conditions. If You do not wish to consent to the terms and conditions please do not use this Website. 

You undertake to be responsible for Your own use of this Website and to use this Website only for lawful purposes. You may not use this Website in any way that breaches any applicable local, national or international law or regulation or that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect. Any and all information and data submitted by You must be accurate and comply with all applicable law in the UK and in any country from which they are posted.  

 

  1. ACCESSIBILITY AND USE 

 

The Website is for Your personal and non-commercial use only. You agree that You are solely responsible for all costs and expenses You may incur in relation to Your use of the Website.  We make no promises that the Website is appropriate or available for use in locations outside of the UK.  If You choose to access the Website from locations outside the UK, You acknowledge You do so at Your own initiative and are responsible for compliance with local laws where they apply. 

We try to make the Website as accessible as possible.  If You have difficulties using the Website please contact Us using the contact details at the top of this page.   

As a condition of Your use of the Website, You are responsible for configuring Your information technology, computer programmes and platform to access this Website.  You should use Your own virus protection software.  We do not guarantee that this Website will be secure or free from bugs or viruses. 

You must not misuse this Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to this Website, the server on which this Website is stored or any server, computer or database connected to this Website. You must not attack this Website via a denial-of-service attack or a distributed denial-of-service attack.  By breaching this provision, You commit a criminal offence under the Computer Misuse Act 1990.  We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them.  In the event of such a breach, Your right to use this Website will cease immediately.

The Website presents information and offers for the sale of used vehicles sold exclusively by approved retailers of the PEUGEOT, CITROËN, VAUXHALL, FIAT, JEEP, ABARTH, DS CERTIFIED and ALFA ROMEO CERTIFIED networks. 

 

Every effort has been made to ensure the accuracy of the information contained in this Website.  The information and illustrations appearing on the pages of the Website, and in particular the models and/or versions presented on the Website as well as their equipment, characteristics, and prices are entered by the retailer at the time of posting or uploading or updating of the various pages of the Website. We cannot be held responsible for any incorrect entry of a retailer.  Check with Your local retailer about items which may affect Your decision to purchase. All amounts shown are in pounds and pence. 

 

Please disregard the mileage unless it is verified by an independent mileage search. MPG figures are achieved under official EU test conditions, intended as a guide for comparative purposes only, and may not reflect actual on-the-road driving conditions.

Approved members of the PEUGEOT, CITROËN, VAUXHALL, FIAT, JEEP, ABARTH, DS CERTIFIED and ALFA ROMEO CERTIFIED retailer network are available to answer questions concerning the products and services presented on the Website. Members of the PEUGEOT, CITROËN, VAUXHALL, FIAT, JEEP, ABARTH, DS CERTIFIED and ALFA ROMEO CERTIFIED retailer networks are independent retailers who remain free to determine their own prices and to participate or not in the operations offered by SPOTiCAR and are solely responsible for the information they provide on the Website.

Part Exchange Valuation 

 

You may use Our Website to get an estimated and indicated valuation of Your existing vehicle. This is a calculation is based on the information You supply through Our Valuation Tool and using information gathered from Our valuation partner Autobiz. You are able to apply the equity funds from Your existing vehicle towards Your deposit for Your new vehicle.  Please note that there are limitations on the amount You can pay as a deposit towards Your new vehicle, which can range from 0 – 40% of a vehicle’s purchase price. 

In order to get a valuation, You will need to supply the registration number and current mileage of the vehicle to which the valuation relates (the “Information”). The Information will be shared with Autobiz.  

 

Any estimate provided does not comprise an offer to purchase Your vehicle by Us, any Retailer, Stellantis Financial Services and is not intended to be relied upon in respect of any application that You make for finance or order You place. It is indicative of the likely valuation and is not guaranteed or binding and may be subject to change. The valuation provided by Autobiz will be shared with and finalised by Your retailer when Your vehicle is inspected during Your appointment with Your retailer. 

 

This valuation will be subject to the retailer being provided with the following: 

  • all copies of the vehicle’s keys You have; 

  • appropriate proof of purchase (if requested by Us); 

  • the Vehicle’s service history (if any); 

  • the Vehicle’s MOT certificate (if any); 

  • the Vehicle’s user manuals (if any); and 

  • any accessories there may be such as a locking wheel nut, radio fascia or remote controls. 

In some instances, failure to provide these items may result in a reduction to the valuation offered to You by the Retailer 

The Retailer may also offer a further contribution towards Your existing vehicle. The valuation is valid for the day of inspection only, after which the Retailer reserves the right to offer a different valuation.  This may be lower than the valuation previously received. The equity from Your existing vehicle payable towards Your new vehicle may therefore be different from any initial indicative value. 

 

If there is any outstanding finance on Your existing vehicle, You will need to ensure that information submitted by You to Us relating to Your existing finance is accurate and up to date and provide Us with all relevant details including the contact details of Your existing finance provider.  Please note the online valuation will not take into account whether there is any outstanding finance on Your existing vehicle, therefore the equity from Your existing vehicle payable towards Your new vehicle may be different from any initial indicative valuation

  1. ACCESS AND LOGIN 

 

Use of the Website  may require registration, particularly in order to access restricted areas of the Website. We are not obliged to permit anyone to register with the Website and We may refuse, terminate or suspend registration to anyone at any time.  You are responsible for making sure that Your password and any other account details are kept secure and confidential. If We have reason to believe there is likely to be a breach of security or misuse of the Website through Your account or the use of Your password, We may notify You and require You to change Your password, or We may suspend or terminate Your account. 

 

Any personal information You provide to Us as part of the registration process will be processed in accordance with Our Privacy Policy. 

 

We will use reasonable efforts to delete accounts which are being used in an inappropriate manner or in breach of these Terms, and identify and remove any content that is inappropriate, defamatory, infringes intellectual property rights or is otherwise in breach of Our Acceptable Use Policy when We are notified, but We cannot be responsible if you have failed to provide Us with the relevant information.

  1. GOVERNING LAW AND JURISDICTION  

 

This Website and these terms are governed by English law. 

 

Any dispute arising in connection with the interpretation or performance of these terms will be referred to the exclusive jurisdiction of the English and Welsh courts except that if You are a resident of Northern Ireland You may also bring proceedings in Northern Ireland, and if You are a resident of Scotland You may also bring proceedings in Scotland. 

 

  1. VARIATION 

 

No changes to these terms are valid or have any effect unless agreed by Us in writing.  We reserve the right to vary these terms from time to time.  Our updated terms will be displayed on the Website and by continuing to use and access the Website following such changes, You agree to be bound by any variation made by Us.  It is Your responsibility to check these terms from time to time to verify such variations. 

 

13. SPOTICAR ELECTRIC CHARGING OFFER

Private retail customers who buy a Qualifying SPOTICAR Used Electric Vehicle (as defined below) from a participating SPOTICAR retailer on Personal Contract Purchase or Conditional Sale through Stellantis Financial Services UK Limited are entitled to choose one of the following at the time of buying the vehicle:

 

  1. A complimentary EV charger (either a 7kW Ohme ePOD EV charger or a 7kW Ohme Home Pro (tethered) EV charger) with standard residential installation by Octopus Energy Ltd (“Octopus Energy”), up to the value of £999; or
  2. £500 public charging credit via Octopus Electroverse

 

(the “Offer”).

The Offer is subject to the following Terms and Conditions between the you and PEUGEOT MOTOR COMPANY PLC trading as SPOTICAR (“SPOTICAR”).

TERMS AND CONDITIONS

By buying a Qualifying SPOTICAR Used Electric Vehicle from a participating SPOTICAR retailer in the UK, you confirm your acceptance of, and agreement to, these Terms and Conditions.

  1. Offer available on used Stellantis brand electric vehicles that have been sourced by the participating retailers from SPOTICAR (“Qualifying SPOTICAR Used Electric Vehicles”) Please contact your local SPOTICAR retailer to clarify which vehicles are eligible/available.
  2. Offer available at participating retailers only. See www.spoticar.co.uk/retailers.
  3. Offer applies to private individuals (18+).
  4. Offer applies to orders made between 14th October 2024 and 5th January 2025.
  5. Only one complimentary EV charger or credit per vehicle shall be provided.
  6. Vehicle must be purchased on either Personal Contract Purchase or Conditional Sale through Stellantis Financial Services UK Limited. Offer not available to cash customers.
  7. The complimentary EV charger and standard installation (up to value of £999) or the £500 credit include VAT.
  8. Offer cannot be used in conjunction with any other offers.
  9. To receive the Offer, you must be a UK resident (excluding Northern Ireland, Channel Islands and the Isle of Man).
  10. Offer not available in Northern Ireland, Channel Islands and Isle of Man.
  11. Your personal data will be handled in accordance with SPOTICAR’s privacy policy, which is available to view at www.spoticar.co.uk/privacy-policy-0.
  12. If you exercise your right to cancel your purchase, you will no longer be entitled to the Offer. If you have already received the Offer by the date on which you cancel or withdraw, SPOTICAR will be entitled to full repayment of the cost of the EV charger (including installation) or the £500 credit provided to you under this Offer.
  13. SPOTICAR reserves the right to change, amend or withdraw this Offer at any point in time. Information is correct at time of publication.
  14. If there is any reason to believe that there has been a breach by you of these terms, SPOTICAR may, at its sole discretion, reserve the right to exclude you from participating in this Offer.
  15. Neither SPOTICAR or its affiliates, agents, officers, or employees will be liable (to the extent permitted by law) for any loss or damage arising out of organising or holding this Offer or as a result of your participation in it, participation in any of the activities or as a result of the collecting or enjoying the vehicle, the EV charger, or the £500 charging credit. This paragraph does not seek to exclude the liability of any party listed in this paragraph for (a) death or personal injury caused by their negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other matter for which it would be unlawful for them to exclude or attempt to exclude their liability. Your statutory rights are not affected.
  16. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to deal with any dispute or claim that arises out of or in connection with these Terms and Conditions and the Offer.

A. Complimentary EV Charger

  1. If you choose to receive the complimentary EV charger (the “EV Charger Promotion”), the participating retailer will refer you to the Octopus Portal to arrange the installation by Octopus Energy of either (a) a 7kW Ohme ePOD EV charger or (b) a 7kW Ohme Home Pro EV charger, up to the value of £999.
  2. In order to benefit from the EV Charger Promotion you must:
    1. Order the relevant EV charger when you purchase your EV vehicle.
    2. Have designated private off-street parking belonging to you that can be accessed at all times.  
    3. Ensure that your utility supplier/provider is able to support installation and running of the EV charger, prior to its installation. 
    4. Qualify for a standard installation as defined by Octopus Energy. If you are not eligible for standard installation you may be liable for installation charges. Eligibility for standard installation will depend upona number of factors, including but not limited to, geographical location. 
  4. Ohme Operations UK Limited (“Ohme”) and Octopus Energy are the third-party suppliers and installers of the EV chargers and you agree to their terms and conditions (available at https://webdev.ohme-ev.com/terms-and-conditions and https://octopus.energy/policies/) and their privacy policies (available at https://webdev.ohme-ev.com/privacy-policy and https://octopus.energy/policies/privacy-policy/).
  5. It is your responsibility to ensure all required third party permissions are sought in relation to the installation of the EV charger at your address.
  6. SPOTICR will not be liable for any costs resulting from the installation or use of the EV charger, including but not limited to the maintenance and repair of the EV charger and associated running costs.

B. £500 Public Charging Credit Via Octopus Electroverse

  1. If you choose to receive the £500 public charging credit via Octopus Electroverse, a unique one-time credit code will be supplied to you on delivery of your vehicle by the supplying participating retailer. The credit will be applied within 7 working days once you have activated your ‘Electrocard’ in-app and input your one-time credit code.
  2. Electroverse is a product supplied by Octopus Energy and not SPOTICAR. You are responsible for setting up an Electroverse account with Octopus Energy via the Electroverse mobile application or at https://electroverse.octopus.energy/ in order to access the £500 credit.
  3. Credit must be activated within 3 months of you purchasing the vehicle.
  4. Pricing for each network and each specific charging point is displayed in the Octopus Electroverse app.
  5. The credit can only be applied to one user account. Once it has been applied, it cannot be undone.
  6. If you close your Electroverse account after activating the credit, any outstanding balance will be lost.
  7. You are responsible for any charges incurred on you Electroverse account above the credited amount.
  8. You may be required to have compatible smartphone with an internet connection or mobile data for charging purposes. The terms and conditions agreed between you and your telecommunications provider will apply to the use of the phone / mobile data connection (charges may apply).
  9. There is no cash alternative to the £500 credit, via Octopus Electroverse. The credit supplied by SPOTICAR is non-transferable and non-negotiable.
  10. Octopus Energy is a third-party supplier and you agree to its terms and conditions (available at https://octopus.energy/policies/) and privacy policy (available at https://octopus.energy/policies/privacy-policy/).
  11. If the £500 credit via Octopus Electroverse is unavailable, cancelled or suspended due to circumstances beyond SPOTICAR’s control, SPOTICAR is under no obligation to offer an alternative and will not owe any further liability to you.
  12. You will not be entitled to any monetary equivalent or compensation for costs or expenses incurred or suffered in connection with taking up the £500 credit via Octopus Electroverse.

Finance subject to status. T&Cs and exclusions apply. Applicants must be 18+. Guarantee may be required. 25 to 48 months term. Finance by Stellantis Financial Services, RH1 1QA. At the end of the agreement there are three options: (i) Part exchange the car, where equity is available (ii) Pay optional final payment to own the vehicle (iii) Return the vehicle. Excess mileage and vehicle condition charges may apply if you return the vehicle. You will only own the vehicle if you pay the optional final payment. Offer applies to SPOTICAR vehicles only. Cannot be used in conjunction with any other finance offer. PEUGEOT MOTOR COMPANY PLC t/a SPOTICAR reserves the right to change, amend or withdraw this offer at any point in time. Correct at the time of publication. PEUGEOT MOTOR COMPANY PLC t/a SPOTICAR is acting as a credit broker and not as a lender and may introduce you to other credit brokers (vehicle retailers).  We will introduce you to Stellantis Financial Services, RH1 1QA as a lender and we may receive a fixed commission for this introduction or no commission at all.  The vehicle retailer, acting as credit broker, will typically receive from the lender a commission, fee or remuneration.  This may be in the form of a fixed fee, campaigns, percentages and/or targets then agreed between Stellantis Financial Services UK Limited and the credit broker.  Alternative finance products may be available with different commission amounts and/or arrangements.  For more details, or if you think this will affect your decision to enter into an agreement, you should ask Stellantis Financial Services or the vehicle retailer (acting as a credit broker) for further information.
